These Terms of Use ("Terms") govern access to and use of the Polaris platform, software, and services (collectively, the "Platform") provided by Polaris Technologies LLC, a Wyoming limited liability company ("Polaris," "we," "us," or "our").
By creating an account, accessing the Platform, or clicking acceptance, you ("Customer," "you," or "your") agree to be bound by these Terms. 1. Platform Description
Polaris provides a software platform that connects to customer owned Meta advertising accounts and analyzes campaign data, performance metrics, creative elements, audience targeting, and bidding strategies using automated systems and machine learning models. Polaris may present optimization recommendations and, upon Customer approval, may directly apply changes to the connected advertising account. Polaris does not provide marketing consulting services, advertising agency services, or performance guarantees.
2. Eligibility and Account Responsibility You must be at least 18 years old and authorized to manage the connected advertising account. You are responsible for all activity conducted through your account, maintaining confidentiality of login credentials, and ensuring compliance with applicable laws and platform policies.
3. Customer Advertising Accounts You retain full ownership and control of your advertising accounts and data. You authorize Polaris to access campaign data, analyze performance metrics, and apply approved optimizations through authorized platform APIs. You are solely responsible for ad budgets, payment to Meta, compliance with advertising policies, and all creative content.
4. Automation and Performance Disclaimer Advertising outcomes are inherently variable. Performance results depend on numerous external factors. Polaris does not guarantee increased leads, sales, revenue, or profitability. You remain solely responsible for approving and deploying optimizations and accept all risks associated with campaign changes.
5. No Professional Advice The Platform does not provide financial, legal, business, or marketing advice. Any insights or recommendations are generated automatically and should not be relied upon as professional guidance.
6. Billing, Subscriptions, and No Refunds All fees are non-refundable. By subscribing, you authorize recurring charges according to your selected plan. You may cancel future renewals prior to the next billing cycle. Billing Disputes: Contact support@polarisforfitness.com within 30 days of any charge believed to be incorrect before initiating a dispute with your payment provider.
Chargeback Fee: If you initiate a chargeback determined to be invalid, you agree to pay a $25.00 administrative fee. 7. Beta Product Acknowledgment The Platform may contain errors, incomplete features, or service interruptions. Polaris may modify, suspend, or discontinue features at any time without liability.
8. Data Ownership and Usage
You retain ownership of your advertising data. You grant Polaris a limited license to access and process data necessary to provide the Platform and to use anonymized and aggregated data to improve product performance. Polaris will not sell your identifiable advertising data to third parties.
9. Acceptable Use
You may not use the Platform for unlawful activities, violate advertising platform terms, upload misleading content, or attempt to reverse engineer the Platform.
10. Indemnification
You agree to indemnify Polaris from all claims arising from your advertising content, violations of policies or laws, or your use of the Platform.
11. Limitation of Liability
Polaris shall not be liable for lost profits, revenue, business interruption, or advertising losses. Total liability shall not exceed the amount paid during the three months preceding the claim. Polaris is not responsible for changes, restrictions, or terminations imposed by third-party platforms including Meta.
12. Termination
Polaris may terminate access for violation of these Terms. Termination does not entitle Customer to refunds.
13. Arbitration and Governing Law
All disputes shall be resolved by binding arbitration. Governing law shall be the laws of the State of Wyoming. Each party waives the right to trial by jury.
14. Modifications to Terms
Polaris may update these Terms from time to time. Continued use constitutes acceptance.
15. Entire Agreement
These Terms constitute the entire agreement between Customer and Polaris regarding Platform use.
